proof, officially valid documents/details (OVDs) accepted for concluding a financial transaction, which may be shared/

uploaded by you, as and when you avail any products or use the Website and to which FHFSL may become privy to.

(including but not limited to any personal data or sensitive personal data as defined under applicable law) or to authorize

FHFSL to derive your data/information from any other source or public registry, as may be necessary to complete your

profile or your application on the website, conduct due diligence on you, assessing your eligibility for the

products/services, undertaking know-your-customer (“KYC”) checks by FHFSL or any other third party and/or to process

your application through this website. Your PI may also be used or shared with third parties including but not limited to

our vendors, service providers, credit information agencies, analytics and research partners, other banks or financial

institutions, insurers or intermediaries or any other third party with the intent of making your experience on the website

better, faster and paperless and frictionless to the extent possible. FHFSL shall adhere to best industry practices including

information security, data protection and privacy law while processing such applications. However, FHFSL shall not be

liable to you for any liability or claims which may arise out of such transactions as any such PI is being collected, used,

processed and shared with your explicit consent.

You hereby authorize and expressly consent us to share your PI with third parties including but not limited to Credit

Information Companies (“CIC”) to do an aggregate check of your credit profile for FHFSL to send you targeted

communications and offers.

Please note that it may take about 72 business hours to process your request. In furtherance to your usage of the Website,

you expressly waive the Do Not Call (DNC) / Do Not Disturb (DND) registrations on your phone/mobile numbers for

contacting you for such purpose and usage. Hence, there will be no DNC / DND check required for the number you may

have left on our website. Such modes of contacting you may include sending SMSs and/ or telephonic calls.

FHFSL reserves the right (and you expressly authorize FHFSL) to share or disclose your PI when FHFSL determines,

in its sole discretion, that the disclosure of such information is necessary or appropriate under the

law for the time being

CREDIT INFORMATION REPORT:

(i)

Your Credit Information (credit score and credit information report) is procured through a search of your credit

records with Credit Information Companies (“CICs”) and FHFSL has no control over the content or accuracy of

information provided in your credit information by CICs. FHFSL gets this information from CIC for

and on your behalf

only when you agree to appoint FHFSL as your lawfully appointed authorized agent/ representative for collecting

your credit information from CICs. By consenting to use and avail your credit information report through FHFSL, you

agree that FHFSL and CICs shall be entitled to rely on your authorization and consent granted by you to FHFSL.

(ii)

Availing your credit information through FHFSL is subject to your passing of appropriate identity

authentication for security and privacy purposes. FHFSL shall not notify you of the reasons if you are unable to pass

such identity authentications and not able to view and/or use your credit information.

(iii)

FHFSL may analyze and profile your credit information in order to process your loan applications or assist you in

identifying and inform you of credit products that are likely to be suited to your circumstances.

OPT-OUT:

In case you do not want to be disturbed over telephonic calls, kindly fill up the details requested in the table below,

including the details of the telephone number(s) on which you do not wish to be contacted and submit the same at

contactus@flyhifinance.com from your email address registered FHFSL. The details that you provide through the opt-

out email will remain confidential and once you have submitted the same to us, your telephone number(s) will be

removed from all our telemarketing calling lists within 15 working days. We will make every effort to ensure that you

partner when your application is submitted and whenever the status of application is updated. FHFSL has a business

relationship with these partners, and you may not opt-out of sharing your information with these partners if you have

applied via a co-branded URL or any other website or directly through the Website as the case may be.

(iii)

In order to provide your bank statement or pay slip electronically along with your loan application, you also must

provide your third-party account credentials ("Account Credentials") to allow FHFSL to retrieve your account data at

those other financial institutions ("Account Information") for your use. Your Account Credentials are only used once to

retrieve your bank statements/pay slips, Form 26 AS or some other income tax related data and are not stored in our

system. FHFSL shall not be liable to you against any liability or claims which may arise out of such transactions

being

carried on your own accord.

(iv)

We may also use third party service providers to provide the service to you, such as sending e-mail messages on our

behalf or hosting and operating a feature or functionality of the service. Our contracts with these third parties outline the

appropriate use and handling of your information and prohibit them from using any of your PI for purposes unrelated to

the product or service they're providing. We require such third parties to maintain

the confidentiality of the information

DISCLOSURE / SHARING:

FHFSL does not disclose PI of a customer except as directed by law or as consent received from the Customer

/ Applicant. No specific information about customer accounts or other personally identifiable data is shared with

parties unless any one of the following conditions is met:

To help complete a transaction initiated by you.

To perform support services through a third-party service provider, provided it conforms to the Privacy Policy of

the FHFSL.

You have specifically authorized it by accepting the General Terms of Use of the website or otherwise.

Where the disclosure is necessary for compliance of a legal obligation or as required by law, such as to comply with a

subpoena, or similar legal process.

When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of

10.INTIMATION BY CUSTOMERS REGARDING CHANGE IN PERSONAL INFORMATION:

information you have provided in an application after a decision has already been made on it; however, you may create

and submit a new application with your updated information.

Note: We will retain your information for as long as your account is active or as needed to provide you services or

required to be retained as per the regulatory guideline or any other law. If you wish to cancel your account or request

to your request within a reasonable time frame. However, we will retain and use your information as necessary to comply

with our legal obligations, resolve disputes, and to enforce our agreements.

11.RETENTION OF YOUR DATA:

(i)FHFSL will retain your information for as long as it is necessary for providing you the Services or required to be retained

as per the regulatory guideline or any other law or your request for termination of your account with FHFSL, whichever is

(ii) Post termination of your account, FHFSL may continue to use your anonymized data aggregated or in

combination with anonymized data of other users. We use this aggregated anonymized data for data analysis, profiling

information along with your application details (if any) for fraud prevention purposes and for the exercise/defense of a

We provide our registered customers with periodic phone calls, mailers and email/SMS/Whatsapp alerts. We also allow

users to subscribe to email newsletters and from time to time may transmit emails promoting FHFSL or third-party

products. Subject to the express consent clause above, FHFSL’s Website subscribers may opt-out of receiving our

i.e., the respective Bank.

The Applicant agrees, understands and confirms that his/ her personal data including without limitation details relating to

Debit card, Net Banking, UPI, wallets, etc. transmitted over the Internet may be susceptible to misuse, hacking, theft

and/ or fraud and that FHFSL or the Payment Service Provider(s) have no control over such matters.

The service is provided using a payment gateway service provider through a secure website. However, neither the

payment gateway service provider nor the FHFSL gives any assurance, that the information so provided online by a user

is secured and may be read or intercepted by a third party. FHFSL does not accept or assume any liability in the event of

such unauthorized interception, hacking or other unauthorized access to information provided by a user of the service.

FHFSL and/or the Payment Service Providers shall not be liable for any inaccuracy, error or delay in, or omission of (a)

any data, information or message, or (b) the transmission or delivery of any such data, information or message; or (c)

any loss or damage arising from or occasioned by any such inaccuracy, error, delay or omission, non-performance or

interruption in any such data, information or message. Under no circumstances shall the FHFSL and/or the Payment

Service Providers, its employees, directors, and its third party agents involved in processing, delivering or managing

the services, be liable for any direct, indirect, incidental, special or consequential damages, or any damages

whatsoever, including punitive or exemplary arising out of or in any way connected with the provision of or any

inadequacy or deficiency in the provision of the services or resulting from unauthorized access or alteration of

transmissions of data or arising from suspension or termination of the service.

The applicant agrees that FHFSL or any of its employees will not be held liable by the applicant for any loss or damages

arising from your use of, or reliance upon the information contained on the website, or any failure to comply with these

Debit Card, Bank Account Details:

The Applicant agrees that the debit card details provided by him/ her for use of the aforesaid Service(s) must be correct

and accurate and that the Applicant shall not use a Debit card, that is not lawfully owned by him/ her or the use of which is

not authorized by the lawful owner thereof. The Applicant further agrees and undertakes to Provide correct and valid debit

card details.

The Applicant may pay his/ her application/initial fees to FHFSL by using a debit card or through online banking account.

The Applicant warrants, agrees and confirms that when he/ she initiates a payment transaction and/or issues an online

payment instruction and provides his/ her card / bank details:

The applicant is fully and lawfully entitled to use such debit card, bank account for such transactions;

•

The applicant is responsible to ensure that the card/ bank account details provided by him/ her are accurate.

•

The applicant authorizes debit of the nominated card/ bank account for the Payment of fees selected by such

applicant

along with the applicable fees.

•

The applicant is responsible to ensure that sufficient credit is available on the nominated card/ bank account at the time

of making the payment to permit the payment of the dues payable or fees dues selected by the a

pplicant inclusive of

the applicable Fee.

No warranty:

No warranty, representation or guarantee, express or implied, is given by the FHFSL in respect of the operation of

Disclaimer and Limitation of liability:

FHFSL does not accept liability for any damage, loss, cost (including legal costs), expenses, indirect losses or consequential

Governing law:

These terms and conditions are governed by the laws of India and the competent courts at Mumbai shall have exclusive

jurisdiction.

Dispute Resolution:

Any dispute arising in relation to the terms and conditions will be submitted to a sole arbitrator appointed by FHFSL under

the provisions of the Arbitration and Conciliation Act, 1996 and rules framed there under. The venue

of Arbitration shall be at

Mumbai.

In general parent / guardian / student may browse this website for obtaining any data or information. However, in order to

access the classified information, one needs to use the credentials provided as a Parent / Guardian

/ Staff / Student user.

parent/guardian/student or third-party making payment or to properly protect data from being seen on their screen by

other persons or otherwise obtained by such other persons, during the online payment process or in respect of any

omission to provide accurate information during the online payment process.

Variations to the Terms and Conditions:

The FHFSL reserves the right to vary these Terms and Conditions from time to time and the current version will

be that

We reserve the right to decline the acceptance of an online payment if your account is in default for any reason. Fly Hi

Financial Services Limited may also make additions/deletions/alteration to the services offered, at its sole discretion. We

reserve the right to withdraw the service at any time at its discretion. We retain the right to change the terms and conditions

for online payments, without any prior notice.

REFUND AND CANCELLATION POLICY

Fly Hi Financial Services Limited will not, under any circumstances, issue refunds for application which were rejected

or declined.

The client understands and agrees that the total invoice amount (bill value) will include the FHFSL processing fee and the

applicable tax. However, the refund would be calculated only on the FHFSL processing fee. The tax component is non-

refundable at any stage.

If the applicant has paid the money through Debit Card or Net Banking, the applicant undertakes voluntarily that he will

not dispute the payment or notify the designated bank for charge back, insisting that the bank to withhold or cancel the

payment made to FHFSL by the applicant. The applicant further undertakes to inform his banker that the payment made

to FHFSL is genuine and the transaction is an exception for his request to cancel or charge back the payment in his favor.

This includes misuse and card loss cases either by him or through anyone else. The applicant agrees to cooperate with

FHFSL in this aspect in case FHFSL wishes to defend/represent the matter in their favor before any bank/authority.

The Service Charges by FHFSL have no reference to the market charges and are as per the company standards to which the

client agreed. Any claims after the registration, like charges being too expensive and such, would not be entertained and

the applicant would have no right to contest the same as it was explained and expressed through all the sources of

information, and the client has been informed before registering.

In case of the application rejected on the following grounds no refund will be made.

•

If the applicant does not comply with the requirements of the Company policy

•

Submission of fraudulent documents.

•

Late submission of any additional documents requested by the credit team at a later stage.

•

The client fails to get the required score in credit bureau / financial eligibility criteria and as advised by the Fly Hi

Financial Services Limited from time to time.

•

Non-communication with FHFSL for a period of 3 months shall also be deemed to be abandonment.

•

The application or processing fee paid to FHFSL is the liability of the client and is not included in the service charges.

FHFSL will not entertain any claim of refund in case of rejection.

•

The client must offer, inside 30 days, each and every paper, forms, and facts that will make it possible for FHFSL process

case. The client’s inability to do the same will only suggest that no reimbursement of the

advisory/consulting/processing fee offered to FHFSL is outstanding.

The client will participate in each and every interview, as and when needed by the concerned processing credit team and

any agency, at the place mentioned by the credit team and any agency, and at his own cost, and swiftly follow each and every

given order as given by the credit team and any agency. The client’s inability to do the same will only suggest that no

refund whatsoever is outstanding of any secretarial charges offered to FHFSL

If the application is returned/rejected/delayed owing to an error in the application fee or mode of payment, the applicant

agrees not to contest on withdrawal of his application on this ground as the payment and the mode of the payment of

application fee is the sole liability of the applicant.

The client should also understand and accept that no refund or transfer of FHFSL fee to a friend or a relative will be done

in the event he or she abandons his/her application or decides to opt out due to any reason during the proceedings after

he/she signs-up.

FHFSL has the right to terminate/withdraw their services without refund of processing/service fee if the applicant

•

does not submit all documents within the stipulated time from the date of his/her registration which is

normally

within one month

•

tries to malign the name of the company in whatsoever manner, which tampers the functioning of the

business

or reputation

•

doesn’t respond to the mails and calls made by the company for more than a month

•

backs out due to personal reasons

The client will inform FHFSL about every news involving a change of housing/mailing address, educational/specialized

credentials, and change of matrimonial status/service or company, newly born kids or any police /unlawful case after the

submission application. The client’s inability to do the same will lead to no refund of processing fees and other upfront

charges if any.

11.

The client shall loyally reveal before FHFSL, each and every detail involving each and every legal case, existing or past,

cases of wrong-doings and/or conviction, and insolvency levelled against the clients and those who are dependent on

him. If he does not reveal such details, and if the same is found afterward, no refunds at all of the money given to FHFSL will

be made.

12.

FHFSL is bound to maintain confidentiality and privacy of a client. Accordingly, FHFSL takes reasonable steps to protect

personal information collected by FHFSL from misuse and loss and from unauthorized access, modification or

disclosure. FHFSL may use and disclose the client’s (and if applicable, the client’s family’s) personal information for

the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the

primary purpose and in other circumstances as authorized by the Privacy Act. In general, FHFSL will disclose the client’s

personal information for the following purposes:

To conduct our business;

•

To provide and market our services;

•

To communicate with the client;

•

To comply with our legal obligations and

•

To help us manage and improve our services

•

It is agreed by the client that she/he knows that FHFSL will deploy its employees and utilize other

infrastructures for providing services to the client by spending considerable amounts of money.

Irrespective

of the result of the application, the client hereby undertakes that he will not claim a refund of the fees and charges

paid to FHFSL, except to the extent provided in the agreement.
